The U.S. Court of Appeals for the Ninth Circuit denied a rehearing for the CA Restaurant Association Ruling versus the City of Berkeley, therefore, the panel’s original ruling holds which found Berkeley’s gas ban in violation of federal law. The ruling extends to Alaska, Arizona, California, Hawaii, Idaho, Montana, Nevada, Oregon, and Washington. As a result, chefs and business owners can use their preferred energy source in their establishments.
